The online sales site www.brettecnica.com (hereafter referred to as the website or online store) is an online sales / e-commerce site developed and operated by Brettecnica - Food Industry Equipment, Lda., Headquartered at Avenida 19 de maio , nr. 4, Pav. 4, 2715-001 Pêro Pinheiro, Portugal, hereinafter referred to as Brettecnica. All persons wishing to make purchases on this site declare that they are of legal age and have the legal capacity to do so. For any purchase made on this site, you are deemed to have read and accepted this Terms and Conditions of Use and Generic Terms of Sale document. This document will always be available online at www.brettecnica.com and can be consulted freely and at any time, even without being registered on the site. Brettecnica reserves the right to modify these general conditions of sale at any time.
These Terms and Conditions of Use and Generic Conditions of Sale set out the rights and obligations of all parties involved in the online purchase and sale process of the articles made available on the site, ie Brettecnica and the person purchasing, hereinafter referred to as User.
3. Registration and contact with the User
In order to proceed with the purchase process the User of the site has to register. During the registration process you will need to provide some personal information. All contact with you will be made to the email address you entered during your registration process. Unless otherwise specified, orders will be shipped to the address you entered during your registration process or alternate address entered by you during the order completion process. Therefore, the User must make every effort to keep his personal data always up to date or present the data for delivery correctly when using the alternative address delivery option. The User is entirely responsible for the truthfulness and validity of the information provided, and Brettecnica hereby disclaims any liability for the possible use of misleading or inappropriate information from reality. Site access data will be sent to the email address that was used during site registration. If you do not receive the email with your login details, we recommend checking your email SPAM folder.
4. Products and Prices
The products available for sale on the site, are those that the user can view during the site consultation, all of them have availability, except stock out. In the latter case, if you have already placed an order, you will be informed later of the eventual unavailability of any item. This information will be given no later than the actual date of dispatch of the order. In the case of an order that has already been paid, Brettecnica will reimburse the User for the amount paid for items not available under 8.3.3. The fact that a product is displayed on the site does not imply that it is available for sale, and therefore Brettecnica does not assume any obligation to make it available. Brettecnica cannot be held responsible for any damages or damages caused by the eventual use of the delivered products. Prices and specifications of each reference may change without notice.
Except where expressly stated, prices quoted on the website are in Euros and apply to a pre-defined territory which may correspond to the Country or Region that the User indicated at the time of registration. This price includes VAT at the standard legal rate in force in mainland Portugal on the day of purchase. Brettecnica reserves the right to change the price of any product at any time and without prior notice and may not assume any differences that the User may claim as a result of this change. Except for any error that may result from the entry of values on the site which may be detected, the selling price of a product will be the unit price stated at the time of purchase. In the event of an error as stated above, Brettecnica is responsible for advising the User of any differences, and Brettecnica has the right to cancel or modify your order or to proceed with it taking into account the correct prices transmitted to you. You are entitled to purchase the product at the wrong price.
The price shown for each item does not include shipping and packaging cost. These costs will be stated during the ordering process. Shipping costs will be explained in more detail in paragraph 6.1 of this document. The User is fully responsible for the payment of fees, expenses, taxes or other amounts required by him.
5. Site Navigation, Orders, Order Tracking and Payment
5.1. Site Navigation
The User can freely browse the site even without being registered in the site and in doing so does not incur any obligation to place an order. Only Users registered on the site may place orders as referred to in point 3. For them the navigation on the site is also free and without the obligation to place any order.
5.2. Order Registration
To register an order the user must have one or more items in the shopping cart and after accessing it must choose the option "Checkout" and "Confirm". Before selecting to Confirm the order you can still remove or add items from the shopping cart on the checkout screen using the “Edit Cart” button. In the next step you should choose the mode of delivery and the payment method. At this stage will be added to the order the value of postage calculated automatically, as described in 6.1.
5.3. Order Payment
In Portugal the User can choose to pay by ATM or Bank Transfer.
5.4. Order Completion
When you select the option "Finalize" the order will be registered and confirmed in our system permanently. Before doing so you can go back and modify your order, the form of payment or delivery, but after “Finalize the Order” it becomes final and it is not possible to change it. The User will immediately receive an email confirming the registration of the order and showing their details, including: ordered items and their prices, shipping costs and applicable payment rates and discounts. The order will be filed by Brettecnica computerically and / or physically for the sole purpose of recording orders placed and their processing. This order form serves as proof of the contractual purchase and sale relationship established between the User and Brettecnica.
5.5. Order Confirmation
All orders will be confirmed by Brettecnica with the sending of a second email that reflects any changes to the order, for lack of any article, and will also inform how the User can proceed with the payment of the order.
5.6. Order cancellation or change
Any order may be canceled at no charge to you within 24 hours of order registration as described in 5.2. The cancellation or alteration of the order must be made to the email email@example.com or other that Brettecnica indicates.
6. Shipping Calculation and Parcel Delivery
6.1. Shipping Costs
Shipping costs are calculated automatically and will be supported by the User. This value may be changed without prior notice due to changes made to the services used by Brettecnica, revision of price lists or error in its calculation. Shipping prices shown are for deliveries to Mainland Portugal.
Likewise, if any change is made to the order taken by Brettecnica or requested by the User, this value will be recalculated and changed if the new value is different from the initially considered.
Shipping costs to the Madeira and Azores Archipelagos will be calculated after the order has been finalized by the user.
6.2. Delivery Modalities
The delivery service will be provided by entities outside Brettecnica and have been selected to ensure rigorous and quality service. Upon registration of the order by the User, the existing options for that order will be automatically displayed, indicating the amount to be paid and the expected delivery time. This service may also be performed through Brettecnica's distribution fleet whenever the address indicated by the User for delivery coincides with some of the distribution routes.
6.3. Delivery time
Estimated delivery time is approximately 3-4 business days for products in stock. If the selected product is not available for immediate shipment, the customer will be informed of the new delivery date. This time is provided by the supplier of the corresponding equipment or service and under no circumstances can Brettecnica be liable for any delay or delivery before the scheduled time.
6.4. Order Delivery
Orders will be delivered to the address you entered during the registration process on the site or, if you used this feature, to the address that was indicated as the alternate delivery address during the ordering process. Any permanent change of address will have to be made by the User updating their registration data. As already mentioned, Brettecnica will not be liable for damages or losses caused by incorrect data in the User file. Brettecnica always recommends choosing a delivery address where someone is to receive your order during normal business hours.
Brettecnica only delivers your orders in Portugal.
7. Personal Data
7.1. Collection of Personal Data
The personal data collected during the registration process on the site are those strictly necessary for the User to be recognized, to be contacted and so that we can provide him a personalized service. Also the data will be used for order processing and so that we can contact the User should the need arise.
Your personal data is of the utmost importance, so Brettecnica recognizes the importance of protecting it, whatever its nature. For this reason, we have developed a set of security measures aimed at protecting them.
7.2. Use and Security of Personal Data
By registering or buying online, you expressly warrant to Brettecnica your consent to use your personal data and address, as well as information regarding your purchases and payment methods. Brettecnica warrants to its Users that it does not rent or sell their data to third parties, so all information is confidential and used only by Brettecnica, except in situations that derive from legal imperatives.
All information provided during registration will be used to:
- Process, complete the data and deliver your order, as well as to notify you about the state of it.
- Ensure that the User Support Service can contact you to provide answers to questions and situations of interest or to communicate new advantages or promotions.
At Brettecnica, access to your information is restricted and is made to satisfy your order, from payment, delivery channels to user support.
Even though all possible precautions for the protection of User data have been developed, Brettecnica cannot be held responsible for any act that is not due to its own negligence.
In situations of misuse of the site and regardless of the legal procedure that may be applied, Brettecnica reserves the right, in particular, to cancel the registration of the user, remove orders and any other type of user content.
7.3. Personal Data Update
The User is solely responsible for updating and validating the personal data collected and should, where appropriate, log in to the site and rectify the data that needs updating.
8. Cancellation, Return of Orders and Exchange of Items
8.1. Order Cancellation and Return
The User may cancel his order if, within 24 Hours, he sends an email to firstname.lastname@example.org or another email that Brettecnica may indicate, expressly expressing this intention.
Upon receipt of the order, the User has a period of 5 days to terminate the purchase and sale agreement entered into on the site (total or partial return of the order), and must notify Brettecnica by email (email@example.com ) or registered letter with acknowledgment of receipt sent to the address given in point 8.2, with a need to state the reason for the exchange.

8.2. Return Procedure
You must send the items you wish to return to Brettecnica, considering the following address:

The exercise of the right of withdrawal (return of articles) must comply with the following conditions:
- Return of articles in proper conditions of use;
- Return items with all labels, including price or bar code;
- Return of the items in the original packaging in perfect condition, with all manuals and accessories included;
- Return of unused articles;
- Products must be returned within five days from the date of receipt of the order, accompanied by proof of purchase;
- Return costs, except in cases duly recognized by Brettecnica, will always be borne by the User. That is, the amount of postage and fees paid by the User upon receipt of the order and the amount you have to pay to return it.
- Indicate to Brettecnica which of the modalities indicated in 8.3 you wish to opt to regularize your return.
8.3. Return Result (Exchange, Voucher Issue or Refund)
Once the User has made a partial or total return of an order, following the rules indicated in point 8.2, he may choose one of the following ways to terminate the purchase and sale agreement and terminate the return process:
8.3.1. Return for exchange for another article
If when making a return, the User wishes to exchange the returned items for other items, he / she must mention his / her intention when communicating the return intention by email, clearly indicating which items he / she wants to receive in return. In this case, in addition to supporting the initial shipping and return shipping costs, the User will also have to support the shipping costs of the new items. In case the value of the returned items is different from the value of the desired articles by exchange, the differences will be rectified as follows: if the returned items are of a lower value than those requested in exchange, the User shall pay the difference if this amount is higher than the items requested in return the User may choose to return the difference by choosing to issue a voucher as indicated in 8.3.2 or refund as indicated in 8.3.3;
8.3.2. Return for Credit Note Issue
When making a return, the User may choose to issue a credit note in the amount of returned items that can be used within 90 days after its issuance in new purchases made on the site;
8.3.3. Return for Refund
The User may also request a refund corresponding to the value of the returned items. In this case, Brettecnica undertakes to reimburse the amount, subject to appropriate adjustments, if applicable in accordance with paragraph 8.4, and shall use, whenever possible, the same route by which payment was made and within 30 days of from receipt of articles in accordance with paragraph 8.2;
8.4. Refunds adjustments
Where the return of one or more items, which have been purchased at a discounted discount based on the purchase price, implies that the minimum purchase price limit for the discount will no longer be met, the refund amount will be adjusted accordingly. according to the amount that was actually paid;
9.1. The equipment and accessories have a warranty period defined by the manufacturer, which, under the legal terms is at least 1 (year) years. This period is considered from the date of invoice of the equipment and can only be exercised upon presentation of the warranty certificate and / or proof of purchase (invoice) duly completed.
9.2. Equipment that has exceeded the period set by the manufacturer or is found to be defective due to abnormal wear, improper installation, weather, electrical discharge, neglect or accident, mishandling, moisture / liquid infiltration, use of unauthorized accessories is considered out of warranty. originals and technical interventions by unauthorized personnel.
9.3. If the equipment malfunctions and is covered by the warranty, the User may go with the warranty and its proof of purchase and / or warranty to a branded service center, or contact Brettecnica and request the move. from a technician.
10.1. The User may submit any contractual conflicts to arbitration and mediation mechanisms that are or may be legally constituted, as well as complain to the Conflict Arbitration Center for acts and omissions that violate the legal provisions applicable to the acquisition of goods.

10.2. The complaint must be filed within 30 (thirty) days from the date of knowledge of the facts by the User, and the ASAE information systems must decide on the complaint and notify the interested party within 30 (thirty) days from the date of receipt.
11. General Site Information and Copyright
All content on the site is the property of Brettecnica and may not, under any circumstances, be reproduced, transferred, distributed or stored without prior written permission.
The photos presented for each product may not accurately represent your reality regarding colors, shapes or details.
Brettecnica is not responsible for the measures determined by the customer to choose the size of the product.
Brettecnica assumes no responsibility for the misuse of any product or for the consequences thereof.
